Equipment Rental Agreement Blanket Form

This agreement serves as a blanket rental form for all equipment listed on the back of this page that is rented in 2024.

I will use the equipment when I pick it up or it is delivered. If I am unable to use it as scheduled, I will reschedule. I will report my progress to the District every 48 hours. If I fail to do so, the district will pick up the equipment and move it to the next user.

  • I assume full liability and responsibility for damages to, or caused by, the equipment (beyond normal wear and tear) from the time I obtain it until I return it to the fairgrounds or it is picked up. I will inspect the equipment and will notify the Monroe Soil and Water Conservation District (SWCD) at (740) 472-5477 as to any problems with the equipment.
  • I fully understand that the use of the equipment described herein involves risks of serious bodily injury, including permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others using the equipment, the conditions in which the equipment is used, or the negligence of any other individual; and that there may be other risks either not known to me or not readily foreseeable at this time; and I fully accept and assume all such risks and all responsibilities for losses, cost, and damages I, or any other person, incur as a result of my use, or any other persons use.
  • I hereby release, and discharge, and covenant not to sue The Monroe Soil & Water Conservation District (hereinafter the Releasees), or its receptive administrators, directors, agents, officers, and employees, other participants, any sponsors, advertisers, from all liability, claims, losses, or damages, on my account caused or alleged to be caused in whole or in part by the negligence of any individual(s) or otherwise, and further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against anyone of the Releasees, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost, which any may incur as a result of such claim.
  • I have read the RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, and understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.

Maintenance & Usage

  • I do agree to pay for parts and labor at a rate of $28 per hour (if it can be fixed at the SWCD) or actual cost if it must be sent to a shop to be repaired.
  • The equipment is greased and oiled by SWCD staff on a regular basis. Renter does not have to grease the equipment unless more than 30 acres are drilled or more than 100 tons of lime are spread.
  • I agree to use the equipment immediately, weather permitting, and will call the SWCD when I am finished with the equipment to report the acres (tons) for billing purposes. The maximum number of days a renter may keep possession of a piece of equipment is five calendar days.
  • I will store the equipment in a dry area when not in use, if possible.
  • I agree to remove all material (seed, fertilizer, lime) from the equipment upon completion. Failure to do so will result in a $50 fee for cleaning.
  • Maximum hauling speed for all equipment (except the Brillion Seeder and Sprayer) is 25 mph.
  • Brillion & Sprayer - Lime spreader can be used for lime only. NO more than 4 ton may be loaded into the hopper at one time. Spreader is not to be used to transport lime on the road. Sprayer can be rented on a daily basis, with a 3-day max. The sprayer must be cleaned; according to the chemical you used specifications after use. Monroe SWCD assumes that the sprayer has been properly cleaned after each use, you rent the sprayer AT YOUR OWN RISK! Monroe SWCD highly recommends that you clean the sprayer prior to use.
  • Corn Planters - Priority in scheduling for the 4-row corn planter will be given to those people planning to plant 10 or more acres. The corn planters are to be ran at 4 mph. The seeding rate is set at 28,000 when it is dropped off. If the renter changes the rate, let the SWCD staff know.
  • Brush Hog - RENTER MAY NOT ATTEMPT ANY REPAIRS ON EQUIPMENT, any damages or breakdowns will be fixed by Baker & Sons and you will be responsible for paying the bill for said damages/breakdowns. Not eligible for out of county rental.
  • Billing terms are “Net due” as outlined in the 2024 pricing guide supplied by Monroe SWCD. If this is not possible, please contact our office to make payment arrangements. Accounts over 120 days will be subject to interest charges at 18% APR.
  • Any accounts that have not had any payments made at the 180-day point will be turned over to the prosecutor for collection.
  • Any user who has previously been turned over for collection, must be current and will be required to pay a deposit of $250 before receiving equipment for use.
  • Upon signing this form, I agree to all terms and conditions.
  • RULES FOR OUT OF COUNTY USAGE

    • Please note that rates for out of county residents will be higher than for Monroe County residents.
    • Priority will be given to Monroe County residents.
    • Mileage will be charged for delivery and pick up out of the county at a rate of $1.00 per mile. This rate will be calculated from the Monroe County Fairgrounds regardless of where the equipment is picked up at, using Google Maps.
    • Monroe County residents who own land in an adjacent county may use the equipment on their out of county land at the in-county rate.
